Introduction

Snov.io (“Company”) is a Company based in the US. The Company provides a sourcing, lead generation and sales automation service Platform from its website and web application by means of Snov.io and third-party crowdsourcing (“decentralized”) data collection methods. The Company’s Platform will connect User/s (the “Data Contributor/s”) with prospective Customers by building B2B communication by finding prospective businesses and reaching out to them as it acts as an email permutator. The service is purely business marketing communication and the User/s of the website or application will be able to register for a free trial. User/s as Data Contributor/s will be involved in the collection and updating of B2B data. As Data Contributor/s they will be able to lead search the database using a variety of criteria depending on their business needs. After the free trial period the Data Contributors may decide whether to cancel the service or continue using the service by registering for the premium service against payment.

You, “your”, “Customer”, “User”, “Data Contributor” are kindly requested to read our Privacy Policy (“Policy”) as it explains how “Snov.io”, “we”, “us” or “our” is committed to respecting your privacy.

The terms "Controller", "Processor", "Data Subject", "Personal Data", "Personal Data Breach", "Processing" and "Supervisory Authority" shall have the same meaning as in the GDPR.

This Policy applies to Users, Data Contributors, and recipients of B2B contacts of:

The website Snov.io;
The web and mobile application app.Snov.io
API methods available by api.snov.io hostname

The above is to be construed together as the “Platform” which includes all its content, services and products offered on or through the Platform.

Both the Privacy Policy and Terms and Conditions for the use of the Platform, including the Cookie Policy, provide the basis of what personal data we collect from you, or how it is processed by us.

By accessing and/or using the Platform, you are accepting and consenting to the practices as described in this Policy whereby we explain:

  1. What type of Personal Data Snov.io collects from you and how it is used;
  2. How we collect your Personal Data and what Personal Data is collected automatically;
  3. How long your Personal Data is retained;
  4. How and when Snov.io shares your Personal Data with others;
  5. How we protect your Personal Data;
  6. What are your rights regarding the use of your Personal Data, including how to access and update Personal Data;
  7. How we treat information submitted to us for use of our services by you or by subscribers to our services;
  8. Whether children under the age of 13 are permitted to use our service.

Under this Policy and depending on the context of the service we provide, Snov.io may be acting as a data “Controller” or as a data “Processor” of your personal data.

When Snov.io acts as a Data Controller

Information we may collect:

  1. The following Personal Data may be collected: we are able to collect your Personal Data when you register as a User for a trial period on the Platform, register as a User on the Platform against payment, open a support request or by corresponding with us by e-mail or otherwise from our support page. In addition, we collect your browsing history but only when Snov.io chrome extension is being used like when you open Snovio extension it sends the website URL you are currently viewing to your own Snov.io account at this URL. This browsing history is never shared with any third party and may be deleted upon request. Extensions Permissions are found at the end of this Policy.
  2. The information we receive upon a purchase may include your name, e-mail address, phone numbers and residence address. Please note that when you purchase a paid Snov.io service “subscription”, your credit card data and Personal Data is not transmitted to us and is not stored on our systems. All of Snov.io credit card Processing is handled by our third-party payment Processors “2Checkout” or “FastSpiring”. Upon purchase of a service 2Checkout or FastSpring may collect User’s e-mail address, phone number, billing address, phone number, credit card details and expiry date.
  3. Information we may collect automatically: On accessing the Platform we may automatically collect the following information:
    When visiting – we collect URL, IP through and from the Platform, including login information, timezone, sign up timestamp, HTTP referrer, web browser type, browser language.
  4. Information collected by third parties: Snov.io works closely with third party service providers in order to provide you with the best service possible. Third party service providers may collect and/or receive information about you.
  5. Google user data

    Snovio is able to integrate with the user's Gmail account to let users send emails via Gmail API. The service integrates into Gmail and needs to connect with your Google account. The only information we store is the email address of the Gmail account you have connected to our service, the access token, and identifiers for drafts and messages sent through the campaign. We use this information only to provide you with the following services:

    Email sending through the Snovio platform on your behalf;
    Tracking of replies to messages sent through the Snovio platform;
    Remind Me feature of Snovio Email Tracker for Gmail;
    Send Later feature of Snovio Email Tracker for Gmail.

    We do not store incoming emails from your Gmail account. In case of a new email in your Inbox, we analyze it using automated algorithms and record only the results of the analysis to provide accurate campaign functioning, campaign statistics, and operability of the “Remind Me” feature in case the sent email receives no reply.

    We do not access your Sent emails through your Gmail account.

    We use access to draft sending in your Gmail account to ensure the operability of the “Send Later” feature.

    We can add a tracking pixel to the body of emails sent through our service to track email opens and edit links in your emails to track link clicks. We use data acquired through these tracking methods to maintain email campaign operability and provide campaign reports.

    You can revoke Snov.io’s access to your Gmail account in the settings page of your Snov.io account here or by uninstalling Snov.io Email Tracker extension from your browser. If you decide to do so, we will lose access to your Gmail account and will no longer be able to provide you campaign sending services through Gmail API or implement Send Later and Remind Me features with Snov.io Email Tracker.

    We delete all data collected from your Gmail account upon request.

    We do not share or pass data to any third parties under any circumstances

    Not all information may contain Personal Data. Some statistical data will be anonymized. The Privacy Policy document does not restrict or limit anonymized data.

  6. Snov.io Email Tracker

    Extension may require authorization in our web application (app.snov.io). User's Personal Data while registering is described in the Section “How Snov.io uses your Personal Data”. Additionally, to use the Send Later and Remind Me features you must allow Snov.io to access your Google account. You can learn more about how Snov.io uses your Google data above.

    Users can send emails through their usual Gmail interface and Snov.io Email Tracker extension will provide tracking information. We’ll let the users know if we think their emails have been opened and how many times.

    We store the subject and identification numbers of emails for the open notifications only. We are using it for tracking, as well as the Send Later and Remind Me features.

  7. Snov.io Email Finder

    To use the extension, you need to be registered at and logged into app.snov.io. User's personal data while registering is described in the Section “How Snov.io uses your Personal Data”.

    Upon User request, extension can collect personal information such as email addresses and business profiles from publicly available sources. Handling and storing of this information occur only at the request of the User. This data is stored in our database and could be found through a search inside the platform. If you do not want your Personal Data to be included as part of our service, you may opt out by contacting us at help@snov.io or opt out from all mailing lists on the Platform through this form.

  8. Snov.io Email Verifier

    To use the extension, you need to be registered at and logged into app.snov.io. User's Personal Data while registering is described in the Section “How Snov.io uses your Personal Data”.

    Extension can collect email addresses from the websites you visit.

    We store the data only upon the user's request, and only if the user clicks the "Save" button. We can use these email addresses to replenish our internal database, and they can be found through a search inside the platform.

  9. Snov.io Web Technology Checker

    To use the extension, you don't need to be registered at or logged into app.snov.io. We collect the following data: Information about websites using specific web technologies (non-personal data). We only store domains from visited websites to help us provide a better user experience.

How Snov.io uses your Personal Data

We collect your e-mail address, IP, location and country to:

Provide you with information and services that you request from us or register to.
Update our records and for general maintenance of your account.
Deal with general queries, complaints or concerns including recovery of passwords.
Notify you about any offers, promotions, surveys or other services that may interest you if you consent to such information; and
Research and develop and evaluate our services to better enhance the Platform.
Automatic Data Collection

We may collect data automatically:

To provide our service to you.
To present content from the Platform in an effective and efficient manner.
To promote a safe and secure Platform.
To enforce our terms and conditions including any legal obligations.
To administer the Platform including internal operations, analysis, research, statistical, troubleshooting and survey operations including advertising.
For suggestions and recommendations.
To evaluate our Customer relationship.

Should we decide to process your Personal Data for any other uses not specified in this Policy, we commit ourselves to informing you at the point when we are to collect your Personal Data.

Direct Marketing

Snov.io will only send you direct marketing communications where you have explicitly consented to receive them. You can opt-out of receiving direct marketing communications from us by following the unsubscribe instructions which are included in the e-mail you receive. Alternatively, you can always send us an e-mail to Customer service at help@snov.io.

Legal Basis

The legal basis for which we act as Controllers as stipulated in the General Data Protection Regulation 2016/679 (GDPR) is follows:

  1. Article 6(1)(b) whereby the Processing of your Personal Data is necessary for the performance of our agreement with you, as Customer.
  2. Article 6(1)(c) whereby the Processing of your Personal Data is necessary for compliance with a legal obligation. Specifically, this relates to financial and accountability data.
  3. Article 6(1)(f) whereby the Processing of your Personal Data is necessary for the legitimate interests of both Snov.io and you as a Customer. (i)To ensure that our systems are secure and for the purpose of performance and error monitoring and incident response. (ii)Improving the performance and User experience of our product.
Who Processes your information?

Disclosure of your Personal Data is limited to employees of Snov.io who within reasonable parameters need to process such information as described hereunder. In the meantime, we commit ourselves to:

Ensure our employees are adequately trained and reliable in a commercially reasonable manner.
Ensure all employees are made aware of the confidential nature of Personal Data. Such process shall be guaranteed by execution of confidentiality agreements to prevent any disclosure of Processing or otherwise both during engagement and after.
Depending on circumstances and if commercially reasonable we shall limit disclosure of Personal Data to only authorized individuals.
Disclosure of information to third parties

We may disclose your Personal Data to the following third parties:

Other members of our group, subsidiaries and/or parent Company and its subsidiaries.
Third party service providers we use to support our business, partner APIs, trusted partners, Google, 2Checkout, Analytics, SendPulse, HelpCrunch, Hotjar and Amazon Web Services (AWS).

Snov.io commits itself to:

  1. Notify the Customer if it receives any complaint, be it relating to data protection or otherwise and fully cooperate with and assist the Customer.
  2. Enter into agreement/s with any third-party Processor prior to disclosing any Personal Data as set out in the GDPR.
  3. Publish on the website and/or application a privacy notice informing all Users of any changes that may affect their Personal Data.
  4. Prior to disclosing any Personal Data to employees, Snov.io is to ensure that all employees have undergone adequate training on data protection and committed themselves to confidentiality whether in written form or otherwise.
  5. Inform you in the event we sell, merge or buy any business or assets whereby we will need to disclose your Personal Data.

We may also disclose your Personal Data to comply with any legal obligation or to enforce our Terms and Conditions, to protect rights, property and safety of our Customers and to safeguard against fraud.

What do we do to safeguard Personal Data?

The security of your information is important for Snov.io and we have implemented administrative, technical and physical safeguards designed to protect Personal Data against theft or misuse. Unfortunately, no system can guarantee complete security of your information. Therefore, your use of the services and communication with us is at your own risk. You are responsible to protect your Username(s) and passwords and for the security of information that you transmit to us over the internet.

Links to other websites

The Platform may contain links to other websites or services. Please note that these websites and services may have their own privacy policies. We do not accept any responsibility or liability for the policies of any third parties. You are encouraged to check the applicable policies before you use or submit any Personal Data to such websites or services.

Right to access and rectification

If Snov.io processes your Personal Data on behalf of or at the direction of one of our Data Contributors, you should first direct your concern to the Data Contributor for assistance regarding modifying, correction of your Personal Data as described in the section titled, “Snov.io as the Data Processor” of this Policy.

GDPR gives you the right to access and request a correction of Personal Data held about you. Please note that access requests may be subject to a nominal fee to meet administrative costs. If you want to access and correct your Personal Data as a registered Customer, you can access your profile and rectify the information provided at any time. You can always contact us at help@snov.io and we shall help you with the changes.

Right to delete Personal Data

If Snov.io processes your Personal Data on behalf of or at the direction of one of our Data Contributors, you should first direct your concern to the Data Contributor for assistance regarding deleting your Personal Data as described in the section titled, “Snov.io as the Data Processor” of this Policy.

Under GDPR you have a right to request deletion of Personal Data we hold about you and we have the obligation to erase your Personal Data, where:

  1. The Personal Data is no longer necessary to the purpose it was collected.
  2. You withdrew your consent for Processing and there is no other legal ground for Processing.
  3. You object to the Processing and there is no overriding legitimate ground for Processing.
  4. Personal Data has been unlawfully processed, or
  5. Personal Data has to be erased for compliance with a legal obligation in the European Union or a Member State Law to which Snov.io is subject.

You may request removal of your Personal Data from our website or services by logging in the application or contacting us at help@snov.io. We shall respond to your request within 30 days.

In the event that we are unable to remove your Personal Data, we will let you know and give you the reason why.

Right to Data Portability

If Snov.io processes your Personal Data on behalf of or at the direction of one of our Data Contributors, you should first direct your concern to the Data Contributor for assistance regarding data portability of your Personal Data as described in the section titled, “Snov.io as the Data Processor” of this Policy.

You have the right to receive a copy of your Personal Data in a common machine-readable format and have it also transferred to another party if technically feasible where:

  1. We are relying on consent or the Processing is necessary for the performance of a contract to which you are party to as a legal basis.
  2. Personal Data is processed by automatic means.

Right to restrict Personal Data Processing

If Snov.io processes your Personal Data on behalf of or at the direction of one of our Data Contributors, you should first direct your concern to the Data Contributor for assistance regarding restriction of Processing of your Personal Data as described in the section titled, “Snov.io as the Data Processor” of this Policy.

You are entitled to restrict Processing of information where:

  1. You contest the accuracy of the Personal Data until corrected or verified.
  2. Processing is unlawful; however, you do not want us to erase Personal Data.
  3. We do not otherwise need your Personal Data, but it is still needed to establish exercise or defend legal claims, which includes storage of Personal Data.
  4. You have objected to Processing justified on legitimate interest grounds, pending verification as to whether Snov.io has compelling legitimate grounds to continue Processing.

You may contact us at help@snov.io should you feel the need to request restriction of Processing of your Personal Data.

Right to object to Processing justified on Legitimate Interest grounds

If Snov.io processes your Personal Data on behalf of or at the direction of one of our Data Contributors, you should first direct your concern to the Data Contributor for assistance regarding objecting to Processing of your Personal Data on legitimate interest grounds as described in the section titled, “Snov.io as the Data Processor” of this Policy.

Where Snov.io is relying upon Legitimate Interest grounds to process Personal Data, you have the right to object to that Processing. Should you object, we agree to stop Processing unless we can either conclusively demonstrate legitimate grounds for Processing that override your interests, rights and freedoms or when Processing of Personal Data is required to establish, exercise or defend a legal claim. We believe we can demonstrate such conclusive grounds when relying on legitimate interest for Processing of Personal Data, but we will consider each complaint on a case by case basis.

Right to be informed when transferring your Personal Data to third country or an international organisation

If Snov.io processes your Personal Data on behalf of or at the direction of one of our Data Contributors, you should first direct your concern to the Data Contributor for assistance regarding safeguards on the transfer of your Personal Data to third countries or international organisations as described in the section titled, “Snov.io as the Data Processor” of this Policy.

You are requested to refer to the Terms and Conditions and this Policy for information regarding the safeguards that have been put in place to protect your Personal Data when transferred outside of the EEA. In relation to transfers to countries not deemed adequate by the European Commission, Snov.io shall ensure safeguards through contractual obligations.

Right to withdraw Consent

If Snov.io processes your Personal Data on behalf of or at the direction of one of our Data Contributors, you should first direct your concern to the Data Contributor for assistance regarding your wish to withdraw your consent of use of Personal Data as described in the section titled, “Snov.io as the Data Processor” of this Policy.

In those circumstances where you provided your consent to Processing of your Personal Data, you retain the right to withdraw such consent at any time, without affecting the lawfulness of Processing based on consent before its withdrawal:

  1. While using certain web browsers and opt-out options as discussed in this Policy.

  3. By following unsubscribe instructions.
Right to submit complaints or report abuse

You reserve the right to lodge a complaint with a Supervisory Authority in your country of residence if you consider that the Processing of your Personal Data infringes applicable laws.

Children under the age of 13

Our website and application do not knowingly collect Personal Data from children under the age of 13. You are asked to submit your Personal Data if you are under the age of 13. If you have any reason to believe that a child under the age of 13 has provided his/her Personal Data to us please contact us on help@snov.io, and we will endeavor to delete the information from our database.

Snov.io as the Data Processor

When Data-Contributors upload to the Platform information containing Personal Data for the purpose of lead generation to be traded, used, transferred, transmitted or communicated, such data may contain Personal Data. For this purpose, you are considered as being the Data Controller for any personal data you upload, trade, use, transfer, transmit or communicate. The natural person or persons referred above are your data subjects and shall be defined in this Policy and terms and conditions as “Client Data”.

By using Snov.io to manage your Client Data it shall be construed that you have engaged us as data Processors on your behalf.

Article 28 of GDPR specifies that a relationship between a Controller and a Processor should be laid down in writing including electronic form. Snov.io shall provide all data-contributors with a data Processing agreement. Contact us at help@snov.io to receive a copy of the agreement. By executing the Data Processing Agreement and by accepting the Privacy Policy and Terms and Conditions you are binding yourself with Snov.io on the Processing of Personal Data of Client Data that you control and establishing the rights and responsibilities of both parties. We shall process your Client Data based on your written instructions as the data Controller unless required by law to act without such instructions.

Snov.io is responsible for the Processing of the Personal Data it receives. We may use third party service providers, contractors or sub-Processors from time to time to assist in providing the relevant service on your behalf. In such case we ensure that we maintain agreements in place to further ensure limiting of access, use, disclosure of Personal Data.

You or other authorized data-contributors of Snov.io may upload, trade, use, transfer, transmit or communicate Client Data as part of the service that may contain Personal Data to you or other individuals. We do not control or view such Client Data and simply process the Client Data on behalf of you in accordance with the terms and conditions. You hereby acknowledge that you or the person uploading, trading, using, transferring, transmitting or communicating Client Data retain sole responsibility for the Client Data and it is being construed that you have obtained all relevant consents or legitimate interest use from the individual to whom any personal data contained within the Client Data relates as per GDPR and ePrivacy Directive. The Processing of that Personal Data by you is not covered by this privacy Policy.

Client Data is personal in the EEA and in the US. It is the responsibility of the Data Contributor to ensure that it has a suitable privacy Policy in place to cover the transmission and Processing of the Client Data and any Personal Data that it contains.

A limited number of Snov.io employees shall have access to your account with your permission to diagnose account issues or for taking action on behalf of a Snov.io Data Contributor. All User accounts accessed by our employees are logged and monitored.

Snov.io retains the Personal Data processed on behalf of our registered Users for a period of a maximum of ten years from when you refrain using our services or as long as needed to provide the services to you and in accordance with our legal obligations, to pursue legitimate business interests, conduct audits, resolve disputes and enforce our agreements.

California Privacy Rights

To the extent provided for by law and subject to applicable exception, California residents have the following privacy rights in relation to the personal information we collect:

This Policy may be reviewed from time to time to reflect any changing legal, regulatory or operational requirements. We encourage our Users to periodically review this page for the latest information on privacy practices. We will endeavor to notify you of any changes that may affect your Personal Data by a privacy notice.
